Why Choose Our Fort Worth Personal Injury Law Firm?

Javier Perez Team

You're dealing with injuries, medical appointments, bills piling up, and an insurance adjuster calling every other day asking you to give a recorded statement or accept a settlement offer. The pressure is immediate, and the stakes are high. That is why we step in to handle the legal process.

  • We document the evidence before it disappears. Accident scenes get cleaned up. Security footage gets erased. Witnesses forget details. We investigate immediately, send preservation letters to trucking companies and property owners, photograph the scene, pull police reports, and interview witnesses while memories are fresh.
  • We prove fault and negligence. Insurance companies argue you were at fault, the hazard was obvious, or the accident was unavoidable. We gather evidence, such as crash reports, maintenance logs, black box data from commercial trucks, prior complaints about property hazards, and medical records, to show the other party's negligence caused your injury.
  • We handle the insurance adjuster. Adjusters work to minimize payouts. They may ask you to give a recorded statement, downplay your injuries, or offer a quick settlement before you know the full cost of your medical treatment. We deal with those calls and pressure tactics. You don't have to face them alone.
  • We calculate the true cost of your injury. A "minor" injury at first may require months of physical therapy, ongoing pain management, or surgery. We work with medical experts as needed to document long-term impact and fight for compensation that covers future treatment, lost earning capacity, and the permanent changes to your life.
  • We're prepared to take your case to court if needed. Most personal injury claims settle, but insurance companies negotiate harder when they know you have a trial-ready lawyer. We've litigated hundreds of cases in state and federal court across Texas. Our lead attorney, Javier Perez, is Board Certified in Labor & Employment Law by the Texas Board of Legal Specialization—a distinction held by fewer than 10% of Texas attorneys. His certification demonstrates the advanced trial skill and legal knowledge necessary to navigate complex litigation in any practice area, ensuring you have an attorney prepared for court.
  • We serve Fort Worth, Arlington, Grand Prairie, and surrounding Tarrant County communities with bilingual support. Featured on Univision and active in the Dallas Hispanic Bar Association, our firm understands the cultural and practical barriers that can keep people from pursuing justice after an accident.
  • We offer free consultations and handle personal injury cases on a contingency fee basis. You don't pay unless we win.

Types of Personal Injury Cases We Handle in Fort Worth

Personal injury law covers any harm caused by someone else's negligence, recklessness, or intentional wrongdoing. Below are the most common cases we handle across Fort Worth and Tarrant County.

Car Accidents

Car accidents are the most common type of personal injury claim in Texas. Distracted driving, speeding, running red lights, drunk driving, and failure to yield all cause crashes that result in serious injuries. Fort Worth's busy highways see frequent collisions, especially during rush hour.

Common car accident injuries include whiplash and soft tissue damage, broken bones, spinal injuries, herniated discs, traumatic brain injuries, and internal injuries.

Truck Accidents

2025 Best Accident Atty Transparent Badge

Commercial truck accidents often result in catastrophic injuries or wrongful death due to the size and weight of tractor-trailers, 18-wheelers, and delivery trucks. Trucking companies and their insurers have teams of lawyers working to minimize liability. We investigate federal trucking regulations, driver logs, maintenance records, and black box data to prove negligence.

Truck accident cases may involve driver error (fatigue, distracted driving, speeding, impaired driving), company negligence (inadequate training, pressuring drivers to violate hours-of-service rules, failing to maintain vehicles), cargo issues (overloaded trailers, improperly secured cargo), and defective truck parts.

Motorcycle Accidents

Motorcyclists face higher injury risk than car drivers because they lack the protection of a vehicle frame. Even a low-speed collision may result in road rash, broken bones, spinal injuries, or traumatic brain injuries. Drivers often fail to see motorcyclists, cut them off, or misjudge their speed.

We handle motorcycle accident cases involving left-turn collisions, lane-splitting incidents (though lane-splitting is not legal in Texas), rear-end crashes, and accidents caused by road hazards (potholes, gravel, debris).

Slip and Fall / Premises Liability

Property owners in Fort Worth owe a duty to maintain reasonably safe conditions for visitors. When a dangerous condition on someone else's property causes injury, the owner may be held liable under Texas premises liability law. Duties vary based on the visitor’s status and whether the hazard was open and obvious.

Common slip and fall hazards include wet floors without warning signs, broken pavement in parking lots, torn carpet or unmarked steps, poor lighting in stairwells or walkways, and falling merchandise in stores.

Premises liability cases also include negligent security claims (assaults or robberies due to inadequate lighting, broken gates, or lack of security cameras), dog bites, swimming pool accidents, and construction site injuries.

Wrongful Death

When negligence causes a fatal accident, surviving family members may file a wrongful death lawsuit to recover compensation for funeral expenses, lost financial support, loss of companionship, and the emotional trauma of losing a loved one.

Texas wrongful death law limits who may file a claim. Surviving spouses, children, and parents of the deceased may bring a wrongful death action. If no immediate family members file within three months, the personal representative of the estate may file.

These cases require sensitivity and thoroughness. We handle the legal process with respect for your grief while holding the responsible parties accountable.

What Damages Can I Recover in a Fort Worth Personal Injury Case?

Texas law allows personal injury victims to pursue both economic and non-economic damages.

Available Economic Damages

Economic damages include:

  • Medical bills (emergency room visits, surgery, hospitalization, physical therapy, prescription medications, future medical care)
  • Lost wages and reduced earning capacity if the injury prevents you from working or limits your ability to earn
  • Property damage (vehicle repairs or replacement)
  • Rehabilitation and assistive devices (wheelchairs, home modifications)

Available Non-Economic Damages

Non-economic damages include:

  • Physical pain and ongoing discomfort
  • Emotional distress, anxiety, depression, and PTSD
  • Loss of enjoyment of daily activities and hobbies
  • Disfigurement or scarring
  • Loss of consortium (impact on your relationship with your spouse)

Punitive Damages

If the defendant's conduct was especially reckless, punitive damages may be available to punish the wrongdoer and deter similar conduct. However, awards of punitive damages are rare and limited. Texas caps punitive damages at the greater of $200,000 or two times economic damages plus non-economic damages up to $750,000, but the cap doesn’t apply in certain felony-conduct cases.

Your personal injury attorney in Texas can help you understand what damages may be available in your case.

Texas Personal Injury Law: Comparative Fault and the 51% Bar

Texas follows a modified comparative fault rule under Texas Civil Practice and Remedies Code Section 33.001. If you were partially responsible for your injury, your compensation is reduced by your percentage of fault. However, if you are found 51% or more at fault, you may not be able to recover compensation.

When insurance companies try to shift blame onto victims to reduce their payout or bar recovery entirely, we push back with evidence showing the defendant's negligence was the primary cause of your injury.

How Long Do I Have to File a Personal Injury Lawsuit in Texas?

With some exceptions, Texas law gives you two years from the date of your injury to file a personal injury lawsuit under Texas Civil Practice and Remedies Code Section 16.003. This deadline, called the statute of limitations, applies to most car accidents, truck crashes, slip and fall cases, and other negligence claims.

Wrongful death claims have a two-year statute of limitations from the date of death. Certain exceptions may extend or toll the deadline, such as injuries to minors or cases where the injury was not immediately discoverable. We evaluate your case to determine which deadlines apply.

If you miss the deadline in your case, you could lose the right to pursue compensation in court. Contact our firm soon after your injury so we can preserve evidence and protect your claim.

What to Do After an Accident in Fort Worth

The steps you take immediately after an accident may strengthen your claim or hurt it. Follow these guidelines:

Seek Medical Care Immediately

Even if you feel okay, some injuries (concussions, internal bleeding, soft tissue damage) may not show symptoms right away. A doctor's evaluation creates a medical record linking your injury to the accident and documents the severity of your harm.

The sooner you speak with an attorney, the stronger your case. Our injury attorneys preserve evidence before it disappears, handle communication with insurance adjusters so you don't say something that hurts your claim, and advise you on what to do next. Call our firm before giving any recorded statements or accepting settlement offers. Early legal guidance protects your rights and prevents costly mistakes.

Report the Accident

For car and truck crashes, call the police and request an official accident report. For slip and fall or premises liability cases, report the incident to the property owner or manager and ask for a written incident report. If they refuse, write down the names of people you spoke with and the time you reported the fall.

If you need help navigating the reporting process or if time has passed since the accident, contact our firm—we can guide you through documentation and work with what's available.

Document the Scene

Take photos of vehicle damage, skid marks, traffic signals, road conditions, weather, and any visible injuries. For slip and fall cases, photograph the hazard (wet floors, broken pavement, poor lighting, missing warning signs) from multiple angles before it's cleaned up or repaired.

Do not worry if you could not. Our attorneys can work with police reports, security footage, witness statements, and other evidence to build your case even when scene photos aren't available.

Get Witness Information

If anyone saw the accident, ask for their name and phone number. Witness statements may confirm fault and counter the other party's version of events.

Keep All Receipts and Records

Save medical bills, prescriptions, pay stubs showing lost work time, vehicle repair estimates, and any other documentation related to your injury and financial losses.

Do Not Give a Recorded Statement

Adjusters may ask you to describe the accident or admit partial fault. Politely decline and refer them to your attorney.

Do Not Accept the First Settlement Offer

Insurance companies often make low initial offers, hoping you'll settle quickly before understanding the full cost of your injury.

FAQ for Fort Worth Personal Injury Lawyer

Do I Have a Personal Injury Case in Fort Worth?

You may have a personal injury case if someone else's negligence caused your injury and you suffered damages (medical bills, lost wages, pain). Contact our firm for a free consultation to evaluate whether you have a valid claim.

How Much Is My Fort Worth Personal Injury Claim Worth?

The value of your claim depends on injury severity, medical costs, lost income, long-term impact on your life, and the strength of evidence showing the other party's negligence. Insurance companies often make early, low offers, hoping you'll settle before understanding the full scope of your damages. We evaluate your case based on current and future costs to pursue fair compensation.

Will My Fort Worth Injury Case Go to Court or Settle?

Most personal injury cases settle before trial. Settlement allows both parties to avoid the time, cost, and uncertainty of a trial. However, if the insurance company refuses a fair settlement offer, we're prepared to take your case to court. Insurance companies negotiate harder when they know you have a trial-ready lawyer. Our attorneys handle both settlement negotiations and litigation.

How Does a Personal Injury Contingency Fee Work?

Javier Perez Law handles personal injury cases on a contingency fee basis. You don't pay any upfront costs or attorney fees. We only get paid if we win your case, either through settlement or trial verdict. Our fee is a percentage of your recovery. If we don't win, you do not owe attorney’s fees. Case expenses are addressed in the fee agreement. This arrangement allows injured people to pursue justice without worrying about legal bills while recovering.

Can I File a Lawsuit After a Drunk Driving Accident in Fort Worth?

Yes. In Texas, a drunk driving accident is a personal injury case based on negligence (for the drunk driver) and potentially gross negligence, which may allow for punitive damages. We pursue claims against the impaired driver to recover compensation for your physical and emotional harm.

Furthermore, Texas law may allow us to pursue a Dram Shop claim against a bar, restaurant, or other establishment that over-served the at-fault driver, if they were visibly intoxicated when served.

We investigate all potential sources of liability to maximize your recovery.
